Summary These Terms govern your use of StephenHolt.com and any related services, content, forms, scheduling, and purchases.

1) Acceptance of these Terms

By accessing or using the Site, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Site. If you are using the Site on behalf of an organization, you represent you have authority to bind that organization.

The Site provides information, educational content, and access to services related to fitness and nutrition coaching, including forms, scheduling, and paid offerings. Any specific scope, pricing, and deliverables for paid services will be described at purchase or in writing.

3) Eligibility

You must be at least 18 years old to use the Site and to purchase services unless a parent or legal guardian provides consent and completes the purchase on your behalf.

4) Accounts, forms, and accuracy

If you submit information through a form or create an account through a third-party tool (for example, a scheduling or coaching platform), you agree to provide accurate information and keep it current. You are responsible for maintaining the confidentiality of any credentials used to access third-party systems.

5) Purchases, billing, and payments

If you purchase services, you authorize us (and our payment processor, including Stripe) to charge your selected payment method. Prices, payment schedules, and renewal terms (if any) will be presented at checkout or in writing.

  • Payment processing: Payments are handled by third-party processors. We do not store full payment card numbers on our servers.
  • Taxes: You are responsible for applicable taxes unless we state otherwise.
  • Disputed charges: If you believe a charge is incorrect, contact us promptly so we can review it.

6) Cancellations and refunds

Cancellation and refund terms (if offered) are specific to the service you purchase and will be provided at checkout or in writing. If no refund policy is stated for a specific purchase, fees are non-refundable to the fullest extent allowed by law.

Note: Some services may require advance notice to cancel future billing, and missed sessions or unused time may not be refundable.

7) Health, safety, and medical disclaimer

Fitness and nutrition involve inherent risks. You are responsible for your own health and safety and for obtaining medical clearance from a physician or qualified healthcare provider before starting any exercise or nutrition program, especially if you have medical conditions, injuries, or are taking medications.

  • Content on the Site is for informational and educational purposes and is not medical advice.
  • Stop immediately if you feel pain, dizziness, or other concerning symptoms and seek appropriate care.
  • Results vary based on many factors, including consistency, history, and health status. No outcomes are guaranteed.

8) No warranties

The Site and its content are provided “as is” and “as available.” We make no warranties of any kind, express or implied, including warranties of accuracy, fitness for a particular purpose, or non-infringement.

9) Third-party services and links

The Site may integrate with or link to third-party services (for example, Google Analytics, Meta, ActiveCampaign, Calendly, Stripe, GoHighLevel). We are not responsible for third-party content, availability, security, or privacy practices. Your use of those services is governed by their terms.

10) Acceptable use

You agree not to:

  • Use the Site for unlawful purposes or to violate any applicable laws.
  • Attempt to gain unauthorized access to the Site, systems, or data.
  • Interfere with Site operation (including introducing malware or abusive traffic).

11) Intellectual property

The Site, including text, graphics, logos, videos, program materials, and other content, is owned by Stephen Holt or licensed for use and is protected by intellectual property laws. You may view and use content for personal, non-commercial purposes only unless you receive written permission otherwise.

12) Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, use, or goodwill, arising from or related to your use of the Site or services.

To the fullest extent permitted by law, our total liability for any claim related to the Site or these Terms will not exceed the amount you paid to us in the 3 months preceding the event giving rise to the claim.

13) Indemnification

You agree to defend, indemnify, and hold harmless Stephen Holt and related parties from claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any rights of another.

14) Termination

We may suspend or terminate access to the Site at any time if we believe you have violated these Terms or if required to protect the Site, users, or third parties. Sections intended to survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.

15) Governing law and disputes

These Terms are governed by the laws of the State of Maryland, without regard to conflict of law principles. Any dispute arising from these Terms or the Site will be resolved in state or federal courts located in Maryland, and you consent to that jurisdiction and venue.

We may update these Terms from time to time. The “Effective date” above reflects the latest version. Material changes will be posted on this page.
